(WND)—Babies born to “invaders” soon could be excluded from the birthright citizenship the 14th Amendment grants, according to a legislative proposal to address the problem raised by President Donald Trump in his executive order on the dispute.
It is U.S. Sen. Jim Banks, R-Ind., who has introduced a plan that would address the Supreme Court’s decision that literally anyone in the world can claim U.S. citizenship and all its benefits for their newborn if that baby is born on American soil.
That has sparked a massive birth-tourism industry and created tens of thousands of U.S. “citizens” who are not living in the U.S., have no loyalty to the U.S., but still claim all the benefits of citizenship.
Banks has proposed a plan that would codify Trump’s 2025 order, declaring illegal immigration across the southern border an “invasion” and adjust the Immigration and Nationality Act to exclude children of those “invaders.”
The legislative solution follows a plan outlined by Supreme Court Justice Brett Kavanaugh in the court’s ruling just weeks ago.
Kavanugh concurred in the ruling, in that the president’s order conflicted with the federal birthright citizenship law. But he pointed out that Congress simply could amend that law to create an exception for those granted citizenship.
A report at Just the News said, “Banks’ legislation would codify Trump’s 2025 executive order declaring illegal migration across the southern border an ‘invasion,’ and change the Immigration and Nationality Act to exclude children of such ‘invaders.’”
Specifically, it states, “Any person who enters the United States without authorization or for the purpose of engaging in birth tourism is considered an invader.”
Meanwhile, Trump has asked the Supreme Court for a rehearing on the dispute, which would be rare but not impossible.
“The Supreme Court’s birthright citizenship decision was an unprecedented assault on American sovereignty, and we must do whatever it takes to save our country,” Banks said in an interview with Fox News. ‘I’m leading the Citizenship Act to reverse the effects of this consequential ruling and ensure the millions of illegal aliens that invaded our country can’t continue to exploit our immigration system.”
